Consumer’s Right of Revocation/Right to Return the Goods

Consumer’s Right of Revocation*

The consumer shall be entitled to revoke his order without giving any reasons within two weeks. Notice of revocation has to be given in text form (for example, by e-mail, fax or letter). The revocation period shall commence no earlier than one day after receipt of the present instruction, however, not before access has been granted and not prior to FIZ Karlsruhe fulfilling its information obligation pursuant to art. 312c para. 2 BGB in conjunction with art. 1 para. 1, 2 and 4 BGB-InfoV and all other obligations pursuant to to art. 312e para. 1 clause 1 BGB in conjunction with art. 3 BGB-InfoV. If the consumer has not received this instruction prior to the conclusion of the contract, the revocation period shall be one month. The revocation period shall be deemed observed if notice of revocation is given within this period. This right of revocation shall prematurely expire if the consumer has used the granted access authorization or IP address prior to the end of the revocation period.

Products sent by consumer if an order has been placed online

Right to Return the Goods* (if goods have been sent, for example books, CD-ROM, etc.)

The customer may return the goods without giving reasons within two weeks. The deadline for returning goods shall commence one day after receipt of this instruction in text form (for example, by letter, fax, or e-mail), however, not before the customer has received the goods and not prior to FIZ Karlsruhe fulfilling its information obligations pursuant to art. 312c para. 2 BGB in conjunction with art. 1 para. 1, 2 and 4 BGB-InfoV and all other obligations pursuant to art. 312e para. 1 clause 1 BGB in conjunction with art. 3 BGB-InfoV. If the customer has not received this instruction prior to the conclusion of the contract, the deadline shall be one month. The deadline shall be deemed observed if the goods are sent back within this period. In any case, FIZ Karlsruhe shall bear the costs and risks of the return.

Consequences of the Return*

In case of an effective return, FIZ Karlsruhe shall restitute to the customer any payments he/she may already have made for the returned goods. If the goods have been deteriorated, FIZ Karlsruhe may claim a compensation for a decrease in value, provided that such decrease in value is not exclusively due to the customer’s inspecting the goods in a manner the customer could have performed in a shop. Besides, the customer may avoid the obligation to compensate for the decrease in value due to a deterioration resulting from his using the goods in accordance with their intended purpose by not using the goods as if they were his property and by refraining from any action that might reduce the goods’ value.

Obligations of reimbursement have to be fulfilled within 30 days. The deadline for the customer shall commence upon sending back the goods, for FIZ Karlsruhe upon receipt of the returned goods in flawless condition.
